1. Agreement to These Terms

These Terms of Service (“Terms”) govern your use of malamatours.com (the “Site”) and your booking or participation in any tour, activity, or transportation service offered by Malama Tours LLC (“Malama Tours,” “we,” “us”), 200 North Vineyard Boulevard, Honolulu, HI 96817. By using the Site or booking a tour, you agree to these Terms. If you book on behalf of others, you confirm you have their authority to accept these Terms for them.

2. Bookings and Payment

Bookings are made through our online reservation system (powered by FareHarbor) or by phone. All prices are in U.S. dollars and, unless stated otherwise, are per person. A booking is confirmed when you receive a confirmation email. Please review your confirmation immediately and contact us if anything is incorrect. Prices, itineraries, and inclusions may change until your booking is confirmed.

3. Cancellations, Changes, and Refunds

Each activity has its own cancellation and refund policy. The policy for your booking is stated on the activity’s page on this Site, during checkout, and in your booking confirmation. That activity-specific policy controls your booking — cancellation windows vary by activity (for example, some require 24 hours’ notice and others 48 hours or more).

  • To receive a refund, you must cancel before the cancellation deadline stated for your activity.
  • Cancellations made after the deadline, no-shows, and late arrivals are non-refundable unless the activity’s policy states otherwise.
  • If we or the tour operator cancel due to weather, safety, or operational reasons, you will receive a full refund or the option to rebook.
  • Date and time changes are subject to availability and to the activity’s cancellation policy.

4. Third-Party Tour Operators

Some experiences sold on this Site are operated by independent third-party companies (for example, adventure parks, cruise operators, luau venues, and attraction operators). For those experiences, Malama Tours acts as a booking agent. The operator is responsible for conducting the activity, and you may be required to accept the operator’s own waiver, terms, and safety rules before participating. Malama Tours is not liable for the acts or omissions of independent operators.

5. Assumption of Risk and Participant Requirements

Many of our experiences are physical, outdoor adventure activities (including ziplining, off-road vehicles, water activities, and hiking) that carry inherent risks. By booking, you confirm that each participant meets the age, weight, height, and health requirements listed on the tour page, and you voluntarily assume the risks of the activity. Participants may be required to sign a liability waiver before taking part. Guests must follow all guide and operator instructions at all times.

We and our operating partners may refuse or remove any participant whose condition or conduct poses a safety risk to themselves or others (including intoxication), without refund.

6. Transportation and Pickup

Where hotel or area pickup is included, pickup and drop-off times are approximate and subject to traffic and operating conditions. Please be ready at the designated location at least 10 minutes before your scheduled pickup. Missed pickups due to guest lateness are treated as no-shows.

7. Personal Property

You are responsible for your personal belongings. Malama Tours and its partners are not responsible for lost, stolen, or damaged items during any tour or transfer.

8. Photos and Media

Occasionally we or our partners photograph or film tours for promotional use. If you prefer not to appear in such media, tell your guide at the start of the activity.

9. Website Use

You agree not to misuse the Site, including attempting to interfere with its operation, scraping content for commercial purposes without permission, or making fraudulent bookings. All Site content, including text, photos, and branding, is owned by or licensed to Malama Tours and may not be reproduced without written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Malama Tours’ total liability arising out of or relating to any booking or use of the Site is limited to the amount you paid for the affected booking. We are not liable for indirect, incidental, or consequential damages, or for events beyond our reasonable control (including weather, natural events, road or park closures, or actions of third parties). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Honolulu, Hawaii.

13. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time of your booking applies to that booking.
